A Bit of Background

The following backgrounds help summarize the author's views on both the general topic: Texas and more specifically 88th Legislature Laws as it relates to that topic.

Brief Summary of Texas

Texas is truly a Republic. There are a multitude of items that to modify the state constitution must be modified. So there are times when Constitutional amendments are on the voting ballots. While I sometimes abhor the wording, the concept that all of those legally able to vote in Texas must vote on the change is a good one. And bills in Texas are generally short, making it easier for everyone to understand.

Summary of 88th Legislature Laws

The blogs here will discuss the laws passed by Congress and signed into law, as well as those, passed by Congress and approved by the voters to become law. There are a multitude of laws and each time I post blogs I will notate here the current effective date if it is different from prior blogs. I am currently posting bills that took effect immediately - those bills total 336. I am currently posting regarding larger bills, so each blog covers a single bill.

Multiple short modifications

SB 464 - Designates October 17 as Entrepreneurs with Disabilities Day.

SB 510 - Attorney information that includes home address, home telephone, electronic mail address, social security number, and date of birth were already considered confidential. Now driver's license number, state identification number, passport number, emergency contact information, or payment information is confidential as well.

SB 599 - District clerk and county clerk are now added to the list of government individuals who may be issued a permit to carry license in their position.

SB 621 - The chief information security office for Texas shall oversee cybersecurity matters. This includes creating a cybersecurity report by November 15 of each even-numbered year; developing statewide information security network; overseeing development of statewide information security policies; collaborating with state agencies; overseeing the implementation of policies; providing security leadership and coordination; providing strategic direction for network security and statewide technology centers; and overseeing preparation of reports. (So we now have a new position, which I am certain will create more new positions and grow government.)

SB - 640 - This law makes the State Preservation Board responsible for the Sam Houston Building; the John H. Reagan Building; the interior portion of the Robert E. Johnson Building that is occupied by a legislative agency; and for any portion of the Robert E. Johnson Building not previously included and for the attached parking facility known as state parking garage P.

The Texas Facilities Commission shall provide facilities management for those listed above that the State Preservation Board is not responsible for; to operate and maintain the central utility plan in the Sam Houston Building; operate and maintain the chiller utility plant attached to the Robert E. Johnson Building; and in phase 2 construction of the Capital Complex master plan set out in the Government code.

For any chamber or committee room occupied by the House and the Senate in the capital, capital extension, or any legislative building; the administrative head must specify the scope, manner, and performance of all work relating to audiovisual systems.

SB 667 - The commission shall establish state historical marker program for honoring African Americans that served in the Texas legislature between 1870 and 1875, during the 12th, 13th, or 14th legislative session. The marker shall be at or near the grave of each former member. If the burial place is unknown or if it is inappropriate, then the marker shall be within the county they served. There is specific text that must be included. Gifts, grants, and donation from public and private sources are to be sought for the purposes of accomplishing this goal.

SB 728 - Adds to the general rules requiring notification to the federal government regarding individuals not qualified to pass a federal firearms background check. Now the state must also report a child who is at least 16: and is found unfit as the result of mental illness or intellectual disability; or found not responsible for their conduct due to mental illness or intellectual disability; or ordered by a court to receive inpatient mental health services; or committed by a court to residential care due to intellectual disability. They must also report an incapacitated adult for whom the court appointed a guardian due to lack of mental capacity.

SB 739 - October 10 is Supportive Palliative Care Awareness Day.

SB 821 - If a state agency sells personal information, then the commission shall determine to whom the data is sold, the purpose for which it is sold, the amount the agency receives in the sale; and the law that authorizes the sale. The commission shall recommendation prohibiting sale of personal information unless it identifies a compelling state interest or public interest justifying the sale.

SB 855 - Creates, and qualifies, certain continuing education requirements for district judges, judges of statutory county court, associate judges, master, referee and magistrate judges. These link toe family violence matters and are meant to ensure the judges are trained in that area.
