A Blog about 88th Legislature Laws

The following backgrounds help summarize the author's views on both the general topic: Texas and more specifically 88th Legislature Laws as it relates to that topic.
Texas is truly a Republic. There are a multitude of items that to modify the state constitution must be modified. So there are times when Constitutional amendments are on the voting ballots. While I sometimes abhor the wording, the concept that all of those legally able to vote in Texas must vote on the change is a good one. And bills in Texas are generally short, making it easier for everyone to understand.
The blogs here will discuss the laws passed by Congress and signed into law, as well as those, passed by Congress and approved by the voters to become law. There are a multitude of laws and each time I post blogs I will notate here the current effective date if it is different from prior blogs. I have worked my way through to the Transportation Code. The Utilities and Water Code will follow.

A declined or failure to process notice must be sent to a toll collection customer immediately. A toll bill sent must clearly state on the exterior of the envelope that is a toll bill and the recipient is expected to pay the amount indicated. Notices may be sent by text if a number is provided and the person elected to receive text notices/messages.
I have to say, I did receive a billing statement once. It was very clear it was a bill and that I was expected to pay it. The confusion for me was that I had a toll tag. I called and there was some confusion on my part because I had failed to update my license plate with them, so it didn't process on the tag. Apparently the tag failed to properly scan at 2 locations and caused the creation of a billing statement due to the license plate update failure on my part. They were kind enough to update the license plate and reduce the tolls to what they would have been with the tag, and it was all charged to my actual toll tag.
HB 2190 - 97 pages
A lot of replacing accident with collision. There were also some re-numbering. And that's the beauty of doing strike throughs and underlining additions - it makes knowing what was changed simple.
HB 2195 - 5 pages
A covering for a license plate that actually covers letters or numbers is an offense. These are considered misdemeanor offenses, generally punishable by fine. There are some modifications for coatings, covering, protective substances or mater that alters, covers, or obscures the license plate. Those have a slightly higher fine, and if a prior conviction they are bumped up further. Multiple priors can result in Class B misdemeanors if taken to trial.
