A Bit of Background

The following backgrounds help summarize the author's views on both the general topic: Texas and more specifically 88th Legislature Laws as it relates to that topic.

Brief Summary of Texas

Texas is truly a Republic. There are a multitude of items that to modify the state constitution must be modified. So there are times when Constitutional amendments are on the voting ballots. While I sometimes abhor the wording, the concept that all of those legally able to vote in Texas must vote on the change is a good one. And bills in Texas are generally short, making it easier for everyone to understand.

Summary of 88th Legislature Laws

The blogs here will discuss the laws passed by Congress and signed into law, as well as those, passed by Congress and approved by the voters to become law. There are a multitude of laws and each time I post blogs I will notate here the current effective date if it is different from prior blogs. I am currently posting bills that took effect immediately - those bills total 336. I am currently posting regarding larger bills, so each blog covers a single bill.

SB 322 - 2 pages

The commissioners court for Matagorda County had compensation to not exceed $50 a day and has been increased to $150 a day. Total for a month use to be maxed at $300 but was increased to $600.

SB 1188 - 8 pages

A director of a special district may be removed if they fail to file an affidavit disclosing an interest in property to be acquired with public funds; repeatedly fails to file a conflicts disclosure statement; does not file a required financial statement; does not file a campaign treasurer appointment form. There were others but these were added.

A director of a special district must be removed if they are convicted or, plead guilty or nolo contendere to a civil or criminal offense of:

  1. bribery;
  2. embezzlement, extortion or other theft of public funds;
  3. perjury;
  4. coercion of a public servant or voter;
  5. tampering with a government record;
  6. misuse of official information;
  7. abuse of official capacity; or
  8. conspiracy to commit or attempt any of the above listed

The board must post notice of a public hearing concerning the removal within 30 days of notice of the violation. Within 30 days of removal, the board must begin the process of filing the vacancy.

A director may not serve on multiple governing boards of different subdivisions. A director is disqualified to service if they don't meet eligibility requirements; file the campaign treasurer appointment form; file all required reports; or if the board determines the relationship or employment exists which conflicts.

A receiver can be requested by the attorney general if the district:

  1. receives 3 consecutive audits with anything other than unqualified or clean opinion;
  2. completes 5 consecutive years of net loss;
  3. has defaulted on more than 1 financial debt obligation;
  4. has a director that was convicted of or plead guilty or nolo contendere to management or governance of the district;
  5. violates a final judgement of a district court in an action brought b the AG;

Permits the Big Bend Regional Hospital District to provide mobile emergency medical services within their district.

SB 1991 - 2 pages

Permits the board for North Harris County Regional Water District to determine the means of authorizing disbursements.
