A Bit of Background

The following backgrounds help summarize the author's views on both the general topic: Texas and more specifically 88th Legislature Laws as it relates to that topic.

Brief Summary of Texas

Texas is truly a Republic. There are a multitude of items that to modify the state constitution must be modified. So there are times when Constitutional amendments are on the voting ballots. While I sometimes abhor the wording, the concept that all of those legally able to vote in Texas must vote on the change is a good one. And bills in Texas are generally short, making it easier for everyone to understand.

Summary of 88th Legislature Laws

The blogs here will discuss the laws passed by Congress and signed into law, as well as those, passed by Congress and approved by the voters to become law. There are a multitude of laws and each time I post blogs I will notate here the current effective date if it is different from prior blogs. I am currently posting bills that took effect immediately - those bills total 336. I am currently posting regarding larger bills, so each blog covers a single bill.

Multiple short modifications

HB 2313 - 3 pages

Transportation networks need to provide drivers that log in to company's network a human trafficking awareness and prevention training materials annually. They must be in digital video format or Internet-based video format; not be less than 15 minutes; be approved by the Texas AG; be provided in English and Spanish; be provided before prearranged rides are authorized; and include the following:

  • experience of human trafficking victims;
  • how and why it happens;
  • how it is defined in state and federal law;
  • guidance on how to identify individuals at most risk;
  • differences between labor and sex trafficking;
  • guidance on the role of a driver on reporting and responding to human trafficking;
  • contact information, including National Human Trafficking Hotline, law enforcement agencies; and number for designated attorney general to report suspected human trafficking

HB 2334 - 2 pages

Licensing is not required for plumbing on private property from a public right-of-way or easement to not less than 5 feet from the structure. This exemption does not include work done for a one-family or two-family dwelling.

Guessing this applies for apartment complexes, office buildings, or retail spaces.

HB 2453 - 3 pages

Occupational licenses may be issued digitally. They must be issued in a secure format and be readily accessible by the license holder through the Internet; must be viewable by the public through the Internet website or using a QR code. If it is issued through a vendor, then the government entity must be able to verify the validity of the license.

HB 2512 - 3 pages

Athletic training means the form of health care including principles and methods of managing and treating athletic injuries for athletics in good general health. Those license must know how to manage the risk of injury or illness; prevent athletic injury or illness; assess athletic injury or illness; provide immediate urgent care; provide therapeutic intervention and recondition athletic injury or illness.
