A Bit of Background

The following backgrounds help summarize the author's views on both the general topic: Texas and more specifically 88th Legislature Laws as it relates to that topic.

Brief Summary of Texas

Texas is truly a Republic. There are a multitude of items that to modify the state constitution must be modified. So there are times when Constitutional amendments are on the voting ballots. While I sometimes abhor the wording, the concept that all of those legally able to vote in Texas must vote on the change is a good one. And bills in Texas are generally short, making it easier for everyone to understand.

Summary of 88th Legislature Laws

The blogs here will discuss the laws passed by Congress and signed into law, as well as those, passed by Congress and approved by the voters to become law. There are a multitude of laws and each time I post blogs I will notate here the current effective date if it is different from prior blogs. I have worked my way through to the Transportation Code. The Utilities and Water Code will follow.

SB 1115 - 3 pages

The definition for an autocycle is updated to include seat belts and steering mechanism. An autocycle is considered a motorcycle but does not apply for a partially or fully enclosed cab.

SB 1136 - 3 pages

Certain counties are called out and listed, but Limestone county is being removed from that list. Which means it is covered in the Transportation Code Section 252 that deals with road commissioner system.

SB 1495 - 3 pages

Personal identifying information that is collected by local government or other board is confidential and not subject to disclosure if it is collected in relation to airport parking. The protected information includes name, address, email, phone number, zip code, license plate number, toll tag number, credit/debit/other payment card number, dates of parking, date the person exited, and the amount that was paid to park.

SB 1499 - 5 pages

Some items were re-named. For instance, rather than a port access improvement project it is now a port connectivity project.

Eligible applicants for funding are limited to 20% of the money appropriated in a fiscal biennium.

SB 1716 - 3 pages

Airport contracts are now permitted to be up to 50 years in length. Previously they were limited to 40 years.

Modifies the route designation for overweight and oversized vehicles through Webb County.

SB 2144 - 4 pages

This is having the commission set a committee to look into current law and any changes necessary for advanced air mobility technology. The committee must have members representing the following:

  1. diverse geographic regions of Texas;
  2. state and local law enforcement;
  3. advanced air mobility industry;
  4. transportation experts;
  5. commercial airport representatives;
  6. vertical takeoff and landing operators and vertiport operators;
  7. local governments;
  8. general public

There needs to be public hearings across the state or via electronic means; comments through an internet website, mail and other methods. They were to submit a written report November 1, 2024. And the committee was terminated January 1, 2025.

Advanced air mobility means aviation transportation that uses highly automated aircraft that are manned or unmanned, that operate and transport passengers or cargo at lower altitudes than commercial, public service, private or recreational purposes.

SB 2150 - 2 pages

A portion of US Highway 84 in Joaquin is designated Lt General O.R. Cotton Whiddon Memorial Highway.
