A Bit of Background

The following backgrounds help summarize the author's views on both the general topic: Texas and more specifically 88th Legislature Laws as it relates to that topic.

Brief Summary of Texas

Texas is truly a Republic. There are a multitude of items that to modify the state constitution must be modified. So there are times when Constitutional amendments are on the voting ballots. While I sometimes abhor the wording, the concept that all of those legally able to vote in Texas must vote on the change is a good one. And bills in Texas are generally short, making it easier for everyone to understand.

Summary of 88th Legislature Laws

The blogs here will discuss the laws passed by Congress and signed into law, as well as those, passed by Congress and approved by the voters to become law. There are a multitude of laws and each time I post blogs I will notate here the current effective date if it is different from prior blogs. I am currently posting bills that took effect immediately - those bills total 336. I am currently posting regarding larger bills, so each blog covers a single bill.

Multiple short modifications

HB 1583 - 4 pages

This is specifically related to the board of the Terry Memorial Hospital District. Directors are elected at large in cumulative voting procedures.

HB 3731 - 7 pages

This is related to the Bandera County River Authority and Groundwater district. This district is created for the public purpose and benefit. Their purpose is water control and improvement district and groundwater conservation.

There are 9 board of directors serving 4 year terms. Two are elected from each commissioners precinct, and 1 at large. There are to be 2 elected every 2 years in November.

They are permitted to have abandoned or deteriorated wells capped or plug and permanently close.

HB 5303 - 82 pages

This creates the Springs Hill Special Utility District. This is a special utility district in Guadalupe and Wilson Counties. It had to be confirmed before 9/1/26, otherwise it would be dissolved 9/1/26. The chapter is set to expire 9/1/27.

Temporary directors are listed until an election can be held. It generally sets this up just like all other utility districts.

It permits an initial water service impact fee.

This creates the North Grayson County Municipal Utility District No. 1. Sets up a utility district. Slightly over half of the bill is the legal description of the land included.

HB 5392 - 27 pages

This creates the Highland Park Municipal Utility District of Grayson County. Sets up a utility district. Slightly over half of the bill is the legal description of the land included.

HB 5414 - 28 pages

This creates the Mountain Springs Municipal Utility District of Cooke County. Sets up a utility district. More than half of the bill is the legal description of the land included.

HB 5415 - 57 pages

This creates the Elm Fork Municipal Utility District No 1 of Cooke County. Sets up a utility district. Majority of the bill is the legal description of the land included.
